Aproximación al programa de derecho.(Universidad de Ibagué, 2018-09-27) Castillo Yara, EsperanzaEl derecho asegura un rol especial en tanto se ocupa de la organización institucional de la sociedad. La enseñanza-aprendizaje del Derecho no debe escapar a la reflexión teórica, filosófica y metodológica. Por ello, abordar cómo los estudiantes de un programa de Derecho hacen uso activo de material teórico y pueden aplicarlo a contextos práctico a través de la evaluación modular, encuentra sentido en este estudio y pone de manifiesto las actividades auténticas en el aula. El trabajo presenta los avances de la investigación que se adelanta para optar por el título de magister en educación de Universidad del Tolima. Su objetivo es resignificar los procesos de evaluación auténtica de los estudiantes, a partir de la construcción de referentes teóricos del Sistema Modular del programa de Derecho de la Universidad de Ibagué 2017-2018. La metodología implementada es de tipo cualitativa, bajo el paradigma interpretativo y diseño de teoría fundamentada. El sistema pedagógico modular puede responder efectivamente a la intensión de formación en competencias. Estas habilidades son muy importantes en la formación jurídica del siglo XXI, cuando se desarrollan en los estudiantes; también son muy apreciadas por los posibles empleadores y, por lo tanto, el uso de una evaluación auténtica mejora las tasas de empleabilidad de los graduados.

- PublicaciónSólo datosEl principio de la buena fe y dineros pagados en exceso por la Administración Estatal: Un análisis de las sentencias del Consejo de Estado(Ediciones unibagué, 2018-12-19) Castillo Yara, EsperanzaIn the following article will be presented the criteria that have been developed in Colombian Council of State Jurisprudence around the non-refoulement of money that was paid in excess by the Administration State, also it describe how the Good faith general principle of law operates; for that aimit was made a study about sentences that this High Court has pronounced in the last ten years, it means that this includes the period between 2007 and 2017, term in which have many judicial decisions that solves this type of claims raised by the State entities, specifically to be initiated annulment and re-establishment of the right claim, which it has been call by some authors as a detrimental action. The effect on the State patrimony is not take into account in judicial decisions, since there is an enrichment and correlative impoverishment of the public Treasury, being cause for the Administration mistakes to recognize and give extra money to individuals. In any case, the application of the presumption of good faith cannot be accepted when the profit was obtained through anilegal action, however, to order to return the money gived to individuals by the Contentious Court, prevails the subjective aspect with which the particular acted to receive those economic benefits.
- PublicaciónRestringidoRelación laboral de los agentes educativos comunitarios en Colombia(Universidad de Ibagué, 2021) Garzón Olivera, Jeimmy Julieth; Castillo Yara, EsperanzaColombia is a social state of law that is characterized by its broad and constant issuance of legal norms. However, despite having a heavy regulation in almost all aspects that revolve around people's socio-legal relationships, there are social realities that the norm does not manage to foresee. For this reason, for the advancement and legal updating of the interpretation by the constitutional bodies of the provisions of the constitution and the law, the foregoing is important in accordance with the social changes that occur and generate new legal needs. Among these realities not provided for in the law are those related to the employment relationship of what were once called "community mothers and fathers." These educational agents execute the program of Hogares Comunitarios de Bienestar (hereinafter, HCB), headed by the Colombian State through the Colombian Institute of Family Welfare (ICBF). Legally, a direct link between educational agents as workers is not established with the ICBF as employer, thus generating a situation of labor outsourcing through the signing of contribution contracts with intermediary entities. Therefore, this project seeks to propose theoretical references based on the claims made by the courts of community educational agents. To achieve this, we start from the analysis of the normative criteria and the jurisprudence of the Constitutional Court of Colombia in order to reveal the labor relationship that has been generated with the State from the HCB program.
